Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Taciturn Studios LLC ("we," "us," or "our") governing your use of DashCanopy at dashcanopy.com and any related services (collectively, the "Service"). By accessing or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and accept these Terms in full.

DashCanopy is a website monitoring and analytics dashboard that allows users to track uptime, response time, visitor statistics, and revenue metrics for websites they own or manage. The Service includes a web application, API integrations, notification system, and related features.

You must create an account to use DashCanopy. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Plans

DashCanopy offers the following subscription tiers:

Billing

Paid subscriptions are billed monthly in advance. All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are in USD and subject to change with 30 days notice.

Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods. If you believe you were charged in error, contact us within 30 days at [email protected].

You agree not to use the Service to:

• Monitor websites you do not own or have explicit permission to monitor
• Conduct denial-of-service attacks or generate excessive automated traffic against monitored sites
• Store, transmit, or process illegal content
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Resell or sublicense access to the Service without written permission
• Circumvent any rate limits, access controls, or security measures
• Use the Service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

You retain ownership of all data you submit to the Service (site URLs, API keys, descriptions, etc.). By using the Service, you grant Taciturn Studios LLC a limited, non-exclusive license to store and process your data solely to provide the Service. We do not claim ownership of your data and will not use it for any purpose other than operating DashCanopy. See our Privacy Policy for full details on data handling.

The DashCanopy name, logo, software, design, and all related intellectual property are owned by Taciturn Studios LLC and protected by copyright, trademark, and other laws. You may not use our branding, trademarks, or proprietary materials without prior written consent.

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice where possible. The Service is provided "as is" and we are not liable for any losses resulting from downtime, data loss, or service interruptions.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TACITURN STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Taciturn Studios LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
